Is a “NO APPEARANCE” in an ANNULMENT OF MARRIAGE CASE possible? Is this a scam?

NO, it is not possible and is most likely a scam, thus, you should not believe individuals who make such claims. In Annulment of Marriage cases, the testimony of the petitioner will be taken and used in the case. Meaning, the appearance of the petitioner is essential; otherwise, his testimony will not be accepted by the Court.


However, take note that it is possible to start the drafting of the petition while you are abroad, since these are preliminary matters between a lawyer and his/her client.  Nevertheless, the petitioner’s eventual appearance in court is still needed once trial starts.


In conclusion, the “no appearance” scheme is usually targeted at OFW’s, thus, please always verify if you are talking to a legitimate lawyer or representative of a Law Firm to avoid wasting hard earned money. If it sounds to good to be true, then it is most likely not true.
